I did not have a chance to listen to this when I was there a few years ago, so I can't say if these demos were done in a studio.

My guess is that the posting was meant to bring some public pressure on Reed's estate to purchase the tapes from them.

I feel like I'm missing something essential in this conversation. How can the tracks have appeared on the album, if Lou's estate/the record company does not have the tape?

But, that aside, the original point I was making is that Omega probably include the warning to inform purchasers that possession of a tape of a recording, even if it is the only copy in existence, does not grant copyright to the material on it. They are letting potential buyers know that they should not buy the tape with an expectation that they will be able to exploit the material on it.

I am sure that the record company hold the master copy of this tape - this is presumably a copy provided by Lou to the LP cover artist so as to provide "inspiration/context" for the artwork.

Deluxe edition? Stuff that! Slap the contents of these tapes onto a 2LP/2CD set, provide a small booklet with contemporary photos and a contextual essay, call it "Lou Reed 1971/1972 Demos" and I'll buy it tomorrow.

That solo acoustic version of "Ocean" blows the official studio version away completely.

I'm not denying that they (the estate) have a copy, but they need to extend copyright on them before the end of the 50 yr mark. If not, and after that, the current owner can use them.

Can confirm they're still on UK iTunes and the sound quality is really good.
