Interesting - didn't know that Kill Yr Sons dated back to the first LP demos
It may date back further. I can't remember where I first heard that it was a lost VU song, but it may well have been on the old "yellow" VU forum. According to some posts on this current forum, Sal Mercuri posted on the yellow forum about a Warhol recording of the VU doing it in 1966, and I may vaguely remember that post too.

he owns the tape and the recordings on it, but not the copyright
I think they could be released in 1972 as the performing rights expire end of '71, I guess. Is the tape '71?

It's in the "Unrecorded/Unreleased" list in Nigel Trevena's booklet so that backs up your memory.

I have the same memory, possibly from the same source, as in my head I've thought of it for a long time as being a song from roughly the time of the Banana album recording, but that might well be only the title/some lyrics, rather than the complete song.

I assume the auction house adds the copyright notice to cover themselves in good faith. The recordings that have already been issued will be covered by copyright in any case. However, the recordings could have been made available surreptitiously to extend copyright. Bowie's estate did this with the Conversation Piece demos. They made them available for streaming on an obscure site for an hour one new years eve and so extended the rights. If I remember rightly, they were also named in ways to avoid searches.

The video's been pulled. "This video is no longer available due to a copyright claim by SME".

I suspect the 1966 version would be lyrically similar to the 1970 version's anti-war protest song style lyrics, rather than the 1974 lyrics about ECT etc. There are one or two other Lou/VU "protest songs" from around the same time, Prominent Men being one, and probably Men Of Good Fortune, which is also on a 1966 Warhol tape.

And in such a case as a tape not owned by the estate or a record company, who is extending the copyright on behalf of whom? Reed's estate do not have this tape.

Hasn't it already been mentioned that 2 of the tracks were on
Transformer as bonus tracks?
